Topture is powered by Shopify, which enables us to provide the Services to you. This Privacy Policy describes how we collect, use, and disclose your personal information when you visit, use, or make a purchase or other transaction using the Services or otherwise communicate with us. Analytics, Advertising and Session Recording

Cookies and analytics

We and our service providers use cookies, tracking pixels and similar technologies — both first-party and third-party — to operate the site, understand how it is used, measure which advertising leads to a purchase, and deliver marketing. Device and usage information collected this way is generally retained for up to 24 months, and advertising and campaign identifiers for up to 90 days, after which it is deleted or aggregated.

Session recording

We use Microsoft Clarity to record and replay sessions on our website. This captures interactions such as mouse movement, clicks, taps, scrolling and page navigation, which we use to diagnose usability problems and improve the site. Clarity is configured to mask text content by default, and we do not use it to capture passwords or payment card details. Recordings are processed by Microsoft as our service provider.

Identity resolution

We use Retention.com, an identity resolution service. When you visit or log in to our website, cookies and similar technologies may be used by our online data partners or vendors to associate these activities with other personal information they or others have about you, including by association with your email address. We (or service providers on our behalf) may then send marketing communications to that email address. You may opt out at app.retention.com/optout.

Your controls

You can opt out of non-essential tracking, including session recording, through our cookie consent banner, and we honor Global Privacy Control signals sent by your browser.

Health Information and HSA/FSA Purchases

We offer the option to pay using HSA or FSA funds through an independent third-party provider. If you select that option at checkout, you are redirected to that provider and any health information you supply — including responses to their questionnaire — is collected and processed by them under their own privacy policy, not by us.

Topture does not collect, receive, store or have access to your health information, questionnaire responses, or any Letter of Medical Necessity. We are not a healthcare provider and we do not determine eligibility. We receive only confirmation that payment has been made.

How We Disclose Personal Information

In certain circumstances, we may disclose your personal information to third parties for legitimate purposes subject to this Privacy Policy. Such circumstances may include:

  • With Shopify, vendors and other third parties who perform services on our behalf (e.g. IT management, payment processing, data analytics, session recording, customer support, cloud storage, fulfillment and shipping). This includes the providers named under Tracking, Analytics and Session Recording above, our freight carriers and the manufacturers whose products we ship to you.
  • With business and marketing partners to provide marketing services and advertise to you. For example, we use Shopify to support personalized advertising with third-party services based on your online activity with different merchants and websites. Our business and marketing partners will use your information in accordance with their own privacy notices. Depending on where you reside, you may have a right to direct us not to share information about you to show you targeted advertisements and marketing based on your online activity with different merchants and websites.
  • With advertising platforms, in hashed form, to measure the performance of our advertising.
  • When you direct, request us or otherwise consent to our disclosure of certain information to third parties, such as to ship you products, to arrange installation, to process an HSA/FSA payment, or through your use of social media widgets or login integrations.
  • With our affiliates or otherwise within our corporate group.
  • In connection with a business transaction such as a merger or bankruptcy, to comply with any applicable legal obligations (including to respond to subpoenas, search warrants and similar requests), to enforce any applicable terms of service or policies, and to protect or defend the Services, our rights, and the rights of our users or others.

Relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Services for you. In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our Store, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our store, along with other merchants, and with Shopify. The Services are not intended to be used by children, and we do not knowingly collect any personal information about children under the age of majority in your jurisdiction. As of the Effective Date of this Privacy Policy, we do not have actual knowledge that we "share" or "sell" (as those terms are defined in applicable law) personal information of individuals under 16 years of age.

Security and Retention of Your Information

Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee "perfect security." In addition, any information you send to us may not be secure while in transit. We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us.

How long we retain your personal information depends on different factors, such as whether we need the information to maintain your account, to provide you with Services, comply with legal obligations, resolve disputes or enforce other applicable contracts and policies. Order and transaction records are retained for as long as required for tax, accounting and warranty purposes.
